Termination of Employment, Redundancy and Compensation

In the previous article on employment and rights of employees we dwelled on matters of contract, minimum standards and obligations, minimum terms of employment, breach and penalties applied. In this paper we will consider issues arising following termination of employment.

The termination of employment legislation was enacted on 27 May 1967 and implemented on 1 February 1968. The basic purpose of the law is the protection of employees following redundancy. Here we will summarize some of the basic tenets of the legislation for guidance. The legislation applies to all employees in the private and public sector but exemptions apply to anyone working outside the scope of the Republic including those employed by the Government of the United Kingdom as in the case of the Sovereign Bases. These employees are covered by other rules specified by their individual contracts of employment.
